By submitting information or material (the "material") for distribution on Emaillink, You acknowledge and agree that the CRC retains the right, in its absolute discretion to edit, delete, reject or refrain from circulating the material and if it does so, the CRC will notify you within a reasonable time of its decision to do so.
The CRC reserves the right to expressly state that any material You submit for distribution on Emaillink does not represent the views or the policy of the CRC or of the State Government and is not endorsed, supported or proposed as such.
You agree to indemnify and keep indemnified the CRC against any liability or loss (including reasonable legal costs and expenses), incurred or suffered by the CRC where such liability or loss is incurred by reason of or in connection with:
(a) any infringement or alleged infringement of any Intellectual Property Rights (including moral rights) arising out of any material You distribute via the Emaillink; and
(b) any unlawful, wrongful, wilful or negligent act or omission by You or by Your officers, employees, agents and contractors.
The name "Emaillink" is used by the CRC as a trade mark (the "Trade Mark").
You acknowledge that the CRC owns all Intellectual Property Rights in the Trade Mark in Australiaand undertake not to take any action which might:
(a) invalidate or put in dispute the CRC's title to the Trade Mark;
(b) oppose any application for registration of the Trade Mark or invalidate or challenge any registration of the Trade Mark in due course;
(c) support an application to remove the Trade Mark as a registered Trade Mark;
(d) cause any Registrar of Trade Marks to require a disclaimer of a monopoly in the Trade Mark,
nor will You assist any other person directly or indirectly in any of the above acts.
"CRC" means the Community Relations Commission of New South Wales established by the Community Relations Commission and Principles of Multiculturalism Act 2000.
"Intellectual Property Rights" includes patent, know-how, copyright, moral rights, design, semi-conductor or circuit layout rights, trade mark, trade, business or company names or other proprietary rights and any rights to registration of such rights, in Australia or elsewhere.
"Trade Mark" means registered Australian trade mark number 1246924 "Em@illink" in respect of "business administration services being the distribution of information for others by electronic means" in Class 35, owned by the CRC.
"You" means the person, corporate or statutory body who has been permitted by the CRC to submit information or material for circulation or distribution via the Emaillink service (including their officers, employees, agents and contractors) and "Your" has a corresponding meaning.
